1. Bidder Registration
The auction is open to the public.
• On-site bidding: To register, you must present a cashier’s check made payable to EP&C AUCTIONS in the amount of $25,000.00 or be otherwise approved by the auction company. If declared the top bidder, this cashier’s check will be applied as a partial deposit, and the buyer must increase the deposit to ten percent (10%) of the total contract price immediately upon signing the contract using a personal check.
• Online/App bidding: Bidders must register through the bid.elliotpaul.com app on Apple or Android devices. Successful online bidders must wire transfer a deposit equal to 10% of the total purchase contract price and return an executed contract within 24 hours from the start of the auction. Failure to do so will result in default. Buyer is responsible for all wire fees.
EP&C AUCTIONS provides internet bidding service as a convenience. If internet failures or delays occur, EP&C AUCTIONS is not responsible for missed bids. Online bidders who want bid certainty should use the max bid feature 24 hours before the auction.
2. Property Inspections
Bidders are encouraged to personally inspect the property. The property is sold AS IS. Buyer pays all closing costs, including but not limited to, documentary stamps, title insurance, and any other applicable fees. Real Estate taxes do not apply because Martin County is the current owner. No representation is made regarding suitability for any specific use. Inspect all property records prior to bidding.
3. Contract Deposit and Payment
Bids cannot be retracted once accepted. All deposits are due the day of sale. The successful bidder must sign the purchase contract immediately following the auction. Terms are not negotiable after the winning bid. If you have not reviewed the Purchase Agreement, do not bid. EP&C AUCTIONS has sole authority to resolve bidding disputes.
4. Form of Auction
The property will be offered subject to seller confirmation. The seller is the Martin County Board of County Commissioners, which has declared the property surplus and authorized its sale.
5. Broker Participation
Licensed real estate brokers may earn 20% of the net commission if:
a) The prospect is registered in writing at least 24 hours prior and countersigned by broker and auctioneer
b) The broker attends the auction with the client and registers onsite
c) Brokers acting as principals are not eligible
d) Broker must be the procuring cause
e) Commission paid only upon successful closing
6. Conduct of Auction
Auctioneer controls all bidding increments, method, and order of sale. Terms may be modified by announcement at auction; announcements take priority over printed materials. Bidders without the required deposit may not bid. Auctioneer may cancel or withdraw the property at any time.
7. Buyer’s Premium
A ten percent (10%) buyer’s premium will be added to the high bid to establish the total contract price.
8. Closing
Balance of purchase price is due no later than thirty (30) days from the auction date. Time is of the essence.
9. Agency Disclosure
Per Florida Statute 475, EP&C AUCTIONS represents the seller exclusively.
10. Recording Notice
This auction will be audio recorded for record purposes.
