1. Bidder Registration
The auction is open to the public.
• On-site bidders: To register, you must present a cashier’s check payable to EP&C AUCTIONS in the amount of $25,000.00 or be otherwise approved by the auction company. If declared the top bidder, the cashier’s check becomes part of your deposit and must be increased to 10% of the total contract price immediately upon signing the contract, payable by personal check.
• Online/App bidders: Register at bid.elliotpaul.com via the “Elliot Paul & Company” bidding app. Online winners must wire a deposit equal to 10% of the contract price and return the executed contract within 24 hours from the start of the auction. Failure to comply constitutes default.
Bidders acknowledge internet service may malfunction. EP&C AUCTIONS is not responsible for missed bids. To ensure participation, use the “max-bid” feature and enter your maximum bid at least 24 hours prior to auction.
2. Property Inspection
All bidders are encouraged to inspect the property personally. The property sells AS-IS. Buyer pays all closing costs including documentary stamps, title insurance, and applicable fees. 2025 real estate taxes prorated to day of closing. No warranties regarding suitability for intended use.
3. Deposit and Contract
Bids are irrevocable once accepted. All deposits due day of sale. Winning bidder must sign the purchase agreement immediately following the auction. Terms are non-negotiable. If you have not reviewed the purchase agreement, please do not bid. EP&C AUCTIONS will settle any bidding disputes.
4. Form of Auction
Property will be sold to the highest bidder, without minimum or reserve. Come prepared to bid.
5. Broker Participation
Licensed brokers may earn 20% of the net commission if:
a) Prospect is registered in writing and countersigned at least 24 hours prior to auction.
b) Broker attends the auction with the client and registers on-site.
c) Brokers acting as principals are not eligible.
d) Broker must be the procuring cause.
e) Commission paid at successful closing.
6. Conduct of Auction
Auctioneer determines bidding method, increments, and order of sale. Announcements at the auction supersede all printed and verbal statements. Bidders without required deposit may not participate. Auctioneer may cancel or withdraw the property at any time.
7. Buyer’s Premium
A 10% buyer’s premium will be added to the high bid to establish the contract price.
8. Closing
Balance due within 30 days of auction. Time is of the essence.
9. Agency Disclosure
EP&C AUCTIONS represents the seller, per Florida Statute 475.
10. Recording Notice
This auction will be audio recorded.
